2022 Legislative Session

MABE's 2022 Legislative Session Highlights

The General Assembly adjourned “sine die” on Monday April 11, 2022 at midnight, bringing to a close a legislative session that featured many major education funding and policy issues. The State Budget funds public education at historic levels and will ensure strong support for all 24 school systems to implement the first school year under the Blueprint for Maryland’s Future Act passed in 2021.

Maryland’s 24 school boards cannot levy taxes, unlike most of the more than 13,000 boards across the nation, so school systems rely on both the state budget and the local government funding guaranteed under our “maintenance of effort” law. The legislature agreed to bolster the minimum amount of local funding required in the 2022-2023 school year, in  a bill that also extends the deadlines for adopting state and local implementation plans for the Blueprint (HB 1450).

The State Capital Budget includes record spending for school construction projects across the state to not only build new schools but also improve the environmental health within existing schools (SB 291). Unfortunately, construction costs are skyrocketing so the funding won’t go as far as hoped. The new Climate Solutions law will incentivize building more net-zero energy efficient schools and require school systems to purchase zero emissions school buses in the coming years (SB 528).

Virtual schools operated by local school systems will be governed by a new law intended to provide a balance of flexibility and accountability (SB 362).  Cybersecurity was the focus of three new laws including one to require state coordination of county, municipal, and school system cybersecurity assessments and responses (HB 1202). New laws will govern school system procurement of educational technology to ensure all platforms and instructional materials are accessible to students with disabilities (SB 617), and impose much stricter requirements and reporting of the use of restraints and seclusion of students as behavioral interventions (HB 1255).

MABE's 2022 Session Positions and Priorities

The 2022 legislative session of the Maryland General Assembly convened on Wednesday, January 12, 2022. The 90-day session adjourned “sine die” at midnight on Monday, April 11, 2022.

MABE’s Legislative Committee has adopted 2022 Legislative Priorities and Positions, which focus on local board governance and funding priorities and provide background on MABE's positions on major policy areas. The Legislative Committee is led by Karen Yoho, Chair (Frederick Co.), and Brenda Wolff, Vice-Chair (Montgomery Co.), includes members from all 24 local boards, and meets regularly throughout the year to discuss and deliberated on legislative and policy matters before the legislature and State Board of Education.

Importantly, MABE’s legislative platform for 2022 continues to reflect the association’s recognition of the devastating health, economic, and educational impacts of the COVID-19 pandemic and the commitment to education funding and policy actions that advance equity and excellence for each of Maryland’s nearly 1 million public school students.

Legislative Positions

MABE's Legislative Positions & Priorities for the 2022 Session include position statements on the following major policy areas:

Priority Issues

Support for governance authority for local boards of education.

  • Specifically, MABE supports local board authority in exercising legislative, judicial, and executive functions, and to adopt education policies and school system budgets reflecting local priorities and resources.

Support for full State funding for Maryland’s outstanding public schools.

  • Specifically, MABE advocates for sustained increases in state and local funding in FY 2023 and beyond to support the Blueprint for Maryland’s Future law to fulfill Maryland’s constitutional duty to adopt a school funding system that ensures equity and excellence in every school.

Support for increased State funding for school construction and renovation projects.

  • Specifically, MABE advocates for increases in state and local funding in FY 2023 capital and operating budgets to support the locally prioritized school facility needs of all 24 school systems.

Support for sustained and increased local government investments in education.

  • Specifically, MABE advocates for state laws mandating investments of local property and income tax revenues in public education, including a strong “maintenance of effort” guarantee that local funding must be sustained and increased from year to year.

  • MABE’s legislative platform reflects the association’s adoption of an equity core value, equity resolution, and equity lens. For MABE, educational equity in Maryland means providing access to essential academic, social, emotional, and economic supports in order to engage each student in rigorous well-rounded instruction toward them achieving their highest potential as learners and citizens.

The COVID-19 Pandemic & Public Education

  • MABE recognizes that all Marylanders, but more specifically our students and families, continue to cope with and recover from the historic and devastating impacts of the ongoing public health, economic, and educational crisis resulting from the COVID-19 pandemic. Maryland’s school systems continue to face extraordinary burdens in teaching and learning, mental health, staffing, facilities, transportation, procurement, and many other areas.
